Dental data and secondary use: consent needs a clear purpose
Distinguish delivery of a dental service from later research, publication or model-development uses.
The guidance
The federal privacy commissioner’s meaningful-consent guidance emphasizes understandable information about personal information practices. For a dental data project, the purpose and the parties involved deserve attention before information is collected or reused.
Our project interpretation
A scan shared to complete a clinical service should not silently become a training dataset. Identify the proposed later activity, the information needed, the permissions and the review process. Research, product development and publication may raise different questions and should not be bundled into an unexplained “improvement” clause.
Prepare a readable explanation
Describe the proposed use in ordinary language and show where questions can be raised. Keep any optional participation choice distinct from the service arrangement where appropriate. Have the responsible privacy and professional reviewers assess the actual project, including any applicable research review. Removing a name from a file is not, by itself, a complete data governance plan.
A closer look
| Focus | What to look at | Why it matters |
|---|---|---|
| Service delivery | Information needed for the agreed service. | Define the initial purpose and parties. |
| Research | A separate investigation. | Assess permissions and any required research review. |
| Model development | Training or improving an algorithm. | Evaluate rights and safeguards for that specific use. |
Frequently asked questions
Does treatment consent automatically cover AI training?
Do not assume it does. Assess the proposed use, permissions and applicable requirements separately.
Is deleting the patient name sufficient?
No. Re-identification risks and information elsewhere in the record must also be considered.
